Vehicle Rental Agreement

This Agreement is between Road Trip Car Rental LLC d/b/a Bluegrass Car Rentals ("Company") and the Renter. It is presented to every renter as a required acceptance step before payment; the version and timestamp of acceptance are stored on the booking record.

1. Renter Eligibility

Renter must hold a valid driver's license and be at least 21 years of age. Renter represents that all information provided to the Company (including date of birth, driver's license number and state, and driving record) is true and correct. Drivers under 25 are subject to a young-driver surcharge as published at booking. The Company reserves the right to decline any rental based on screening results.

2. Authorized Drivers

Only the Renter identified on the booking is an Authorized Driver. No other person may operate the Vehicle unless that person is listed on the booking and meets the eligibility requirements above. Any unlisted driver is in breach of this Agreement and Renter is fully responsible for all consequences.

3. Personal Auto Insurance — Primary and Required

Renter must maintain personal automobile insurance that covers rental vehicles and is the primary coverage for the Vehicle during the rental period. The Company does not offer a damage waiver or collision damage waiver for purchase. Renter's personal auto insurance is solely responsible for damage to the Vehicle, theft, and third-party claims. Renter authorizes the Company to verify coverage with Renter's insurer before releasing the Vehicle.

4. Damage Responsibility

Renter is financially responsible for ALL damage to or loss of the Vehicle during the rental period, regardless of fault and regardless of whether Renter's insurance covers the loss. No damage waiver is offered. Renter agrees to pay: (a) all repair costs to restore the Vehicle to its pre-rental condition; (b) loss of use at the daily rental rate for the period the Vehicle is unavailable; (c) diminished value; (d) towing, storage, and impound fees; (e) administrative fees related to damage processing; and (f) any deductible or uncovered amount under Renter's insurance policy.

5. Prohibited Uses

The Vehicle shall NOT be used: (a) by any person not listed as an Authorized Driver; (b) for any illegal purpose; (c) while the driver is under the influence of alcohol, drugs, or any controlled substance, or in any impaired or reckless manner; (d) to transport persons or property for hire, including ride-share or delivery services, unless approved in writing by the Company; (e) in any speed contest, race, or competition; (f) for off-road use; (g) to push or tow any vehicle or object; (h) to transport hazardous, explosive, or flammable materials; (i) outside the state of Kentucky without prior written authorization; or (j) when any warning light is illuminated without immediately notifying the Company.

6. Tickets, Tolls, and Violations

Renter is responsible for all parking citations, traffic violations, toll charges, photo-enforcement citations, and any other fines or penalties assessed against the Vehicle or Renter during the rental period. Renter agrees to pay an administrative fee of $25 per violation processed by the Company in addition to the underlying fine.

7. Late-Return Fees

Renter must return the Vehicle at the agreed date, time, and location. Late returns incur a fee of $50 per hour, up to the full daily rate, at the Company's discretion.

8. Fuel Policy

The Vehicle is provided with a full tank of fuel and must be returned with a full tank. If returned with less than a full tank, Renter authorizes a refueling charge of $9.99 per gallon plus a $15 service charge.

9. Security Deposit

Renter authorizes the Company to place a hold on Renter's payment method for a security deposit of $100 at pickup. The deposit is released after return if the Vehicle is undamaged and all charges are settled. The Company may charge the deposit for any unpaid damage, fees, tolls, or violations.

10. Vehicle Condition Documentation

The Vehicle's condition is documented with photographs at pickup and return. Renter acknowledges that the Company's condition report is the controlling record. Renter may submit Renter's own photos at pickup and return through the self-service portal.

11. Breakdown or Accident Procedure

In the event of a breakdown, accident, theft, or other incident, Renter must notify the Company immediately. Renter must file a police report for any accident and obtain a copy for the Company. Renter must not leave the scene of an accident before reporting it to the Company and the police.

12. Limitation of Liability

To the maximum extent permitted by Kentucky law, the Company's liability for any claim arising from this Agreement is limited to the total rental charges paid by Renter for the rental in question. The Company is not liable for indirect, incidental, consequential, or punitive damages.

13. Indemnification

Renter agrees to defend, indemnify, and hold harmless the Company, its owners, employees, and agents from all claims, damages, losses, costs, and reasonable attorneys' fees arising from Renter's use of the Vehicle, any violation of law, or any breach of this Agreement. This obligation survives the rental period.

14. Assumption of Risk & Release

Renter voluntarily assumes all risks of operating a motor vehicle, including accident, injury, and death. To the maximum extent permitted by law, Renter releases and waives all claims against the Company arising from the use of the Vehicle.

15. No Warranties

The Vehicle is provided "as is" and the Company makes no warranties beyond those required by Kentucky law. The Company does not warrant that the Vehicle is fit for any particular purpose.

16. Smoking & Cleaning

No smoking of any kind is permitted in the Vehicle. Violation results in a minimum $150 cleaning fee. Excessive soiling or detailing fees range from $150 to $500 at the Company's discretion.

17. Personal Property

The Company is not responsible for any personal property left in or on the Vehicle.

18. Repossession

The Company may repossess the Vehicle without notice if Renter breaches this Agreement, uses the Vehicle unlawfully, or fails to pay amounts when due. Renter pays all repossession costs.

19. Governing Law & Venue

This Agreement is governed by the laws of the Commonwealth of Kentucky. Any dispute is resolved exclusively in the courts located in Fayette County, Kentucky. The prevailing party is entitled to reasonable attorneys' fees and costs.

20. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or representations. No modification is effective unless in writing and signed by both parties. If any provision is held unenforceable, the remainder continues in full force and effect.
